Article 1: Scope of Application and Modification of the General Conditions of Sale
These general terms and conditions of sale apply to all orders placed on the website boutique.domainedemarie.com, an e-commerce service published by the company SCEA DOMAINE DE MARIE.
The publisher reserves the right to adapt or modify these general terms and conditions of sale at any time. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.
Article 2: Availability of products
Our product offers and prices are valid as long as they are visible on the site, within the limits of available stocks.
Upon receipt of your order, we check the availability of the product(s) ordered. In the event of unavailability, we undertake within 14 days from the validation of the order either to deliver the product ordered or to offer you a similar product at a similar price or to reimburse you by check.
The order validation date corresponds to the order date in the case of payment by credit card online or upon receipt of your check when paying by order form.
Article 3: Validation of orders and electronic signature (law of March 13, 2000 on electronic signature.)
Any purchase order signed by the consumer by "double click" constitutes an irrevocable acceptance which can only be challenged within the limits provided for in these general conditions of sale in the same way as the "right of withdrawal" and "out of stock".
The "double click" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages constitutes an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.
Article 4: Price
Domaine de Marie reserves the right to modify its prices at any time but undertakes to apply the prices in force which will have been indicated to you at the time of your order, subject to availability on that date.
Our prices include:
• All taxes included for deliveries made within the European Union. The VAT collected may be that of the country of origin or that of the country of destination, according to the provisions of each Member State.
Please note: the VAT refund service for travellers leaving the EU with their goods is not offered by Domaine de Marie.
• Excluding taxes for deliveries made outside the European Union. Import duties and taxes, as well as any customs clearance fees, are then due to the local customs authorities, by the recipient of the goods, according to the customs procedures of each country. Domaine de Marie declares the real market value of its shipments. Under no circumstances can the amount of these duties, taxes and fees be claimed from Domaine de Marie. It is understood that the customs authorities will contact the recipient, by all means communicated by the customer when ordering. In the event of inability to contact the recipient, or if the recipient refuses to pay the duties, taxes and customs fees, the package may be returned to Domaine de Marie, and the amount of the order will then be refunded to the customer, less the transport costs and the cost of returning the package.
